All work is measured against agreed proposals, tailored to individual client requirements.
Offers and prices quoted are valid for up to 30 days and are given in GB Pounds Sterling. All orders must be paid for in full at the times specified in the proposal for services to continue.
All Web pages, designs, underlying coding and other works (including copyright where relevant) will remain 31prime.com property and title or the right to use any of this intellectual property shall not pass to the client until such time as full and final payment has been made in accordance with the proposal (as modified if relevant by any other agreements made with you that may affect the amount of work to be done or services to be provided).
The client should settle any payments due for domain or hosting services. 31prime.com shall not be responsible for any interruption in service due to, for whatever reason, fees not being settled by the client. Should there be any suspension or interruption of services from a supplier of services to the client for whatsoever reason, then 31prime.com shall not be held responsible (even if that supplier is one that may have been suggested or recommended by 31prime.com). It is strongly recommended that the client perform their own due diligence should the services be of major importance to themselves unless as part of the proposal and agreement 31prime.com have taken on board this task.
Websites and their supporting databases are sometimes subject to attack by malicious individuals (such as ‘hackers’). In such an eventuality, the client will not hold 31prime.com responsible for the consequences of such attacks.
In the event that the client, client’s website or client’s email, attract traffic which is excessive or exceeds expectations in either the short or long term, then the client should note that the clients hosting company may apply traffic charges accordingly.
On occasions and from time to time, service by the client’s chosen hosting company may be interrupted for maintenance, repairs or other reasons. Normally such interruptions will be short lived. If the client had arranged their own hosting they need to inform 31prime.com during the active stage of a project, should any interruption be longer lived – the client should note that 31prime.com will not be monitoring or testing the site after it is goes live unless there is an agreement to do so.
The situation with Search Engines and their ranking methodologies is constantly changing. Within design constraints, 31prime.com will do what is necessary for the site to be ‘friendly’ to Google and Yahoo. Because no Search Engine will guarantee to accept, consider, place, or to keep if placed, any submission whether paid or not, it is impossible for 31prime.com to make any guarantee whatsoever concerning Search Engines results or that they can be sustained, If SEO services have been taken on the we will do our best endeavour to improve the clients ranking with the top search engines as agreed within individual client proposals.
Unless agreed otherwise, the client will be responsible for providing the text and image content for the website. The client warrants that they own the copyright to such content or otherwise have the appropriate right to use such content.
If there are no arrangments for backup with 31prime then the client shall be responsible for keeping their own back-up copies of all content published or transmitted, including the Web Pages designed by 31prime - 31prime will not be responsible for any file recovery or for files lost by the client, or by any other person, organisation or Internet Service Provider.
In the event that you decide not to make use of the full time period for services which have been paid for in advance, refunds will be given pro rata for any unused part of that time.
31prime.com liability is limited in all respects to the price paid. 31prime.com shall under no circumstances be liable for any indirect or consequential loss howsoever caused. 31prime.com will not be liable in any circumstances for loss of profit suffered.
31prime mainly contacts via email unless you request otherwise. It is your responsibility to keep 31prime.com informed of any change in email address and other contact details. If, as a result of you failing to inform me accurately and timely with good notice of your changed details, or if you fail to retrieve or access notifications from me that you may need to act on eg. Domain name payments, the client will not hold 31prime.com responsible for the consequences of not acting on these communications to the client.
In any dispute this contract is governed by the Laws of England. |
